1. 接受条款
欢迎使用宠伴 AI(PetPal,以下称"本应用"或"服务"),本服务由 PetPal(以下称"我们")提供。当你下载、访问或使用本应用,即表示你已阅读、理解并同意受本服务条款("本条款")及 隐私政策 约束。如你不同意,请勿使用本应用。
2. 使用资格
本应用并非面向 13 岁(部分地区为 16 岁)以下儿童。你声明并保证你已达到所在地的最低法定年龄,且具备订立本条款的完全民事行为能力。若你代表某组织使用,则你保证有权代表其接受本条款。
3. 服务说明
本应用通过 AI 为你提供:(a) 猫狗品种识别(Top-3 + 置信度);(b) 情绪趣味解读(仅供娱乐);(c) 健康初筛与宠物健康档案 / 提醒(订阅功能)。具体功能可能随版本更新而增删。
4. 重要:辅助参考,非兽医诊断(合规核心)
- 本应用的全部 AI 输出为辅助性筛查参考(screening aid),不构成兽医诊断、治疗、处方或专业意见,不能替代持牌兽医。
- 健康初筛仅提示可能值得关注的表现,无法确诊任何疾病;每个健康结果均附置信度与免责声明,并在异常/不确定时引导你联系持牌兽医。
- 多数司法辖区要求在远程诊疗/开方前建立 VCPR(兽医-客户-患者关系,通常需近 ~12 个月内当面检查);本应用既不持有兽医执照亦无法建立 VCPR,故仅做转诊/分诊,不做诊断或开方。
- 情绪解读仅供娱乐,不作任何科学或准确性承诺。
- 紧急情况:若你的宠物出现紧急或严重症状,请立即联系持牌兽医或急诊,不要依赖本应用。你基于本应用信息所做的任何决定由你自行负责。
5. 你的账户与责任
如本应用提供账户功能,你须对账户凭证的保密与账户下的活动负责,并保证所提供信息真实、准确、完整。你同意不滥用、不干扰服务的正常运行。
6. 用户内容与照片授权
- 你上传的宠物照片、档案信息等("用户内容")的所有权归你。
- 为向你提供功能,你授予我们一项有限、全球、非独占、免版税的许可,仅用于处理、传输、存储和展示你的用户内容以实现服务(如将照片发送至 AI 推理网关进行识别)。照片默认仅瞬时用于推理、用完即弃,仅当你主动保存进档案才会被加密存储(详见隐私政策)。
- 你保证对所上传内容拥有必要权利,且其不侵犯他人权益、不违反法律。
7. 可接受使用
你同意不:(a) 将本应用用于任何非法目的或违反本条款;(b) 上传侵权、违法或含恶意代码的内容;(c) 逆向工程、反编译、破解或试图获取源代码(法律明确允许的除外);(d) 干扰、攻击、过载服务或绕过限频/安全机制;(e) 抓取、批量自动化访问或转售服务;(f) 将健康初筛结果对外冒充为兽医诊断。
8. 订阅、计费与自动续订
- 免费与付费:品种识别与情绪解读为免费;健康初筛、宠物档案与提醒为**订阅(Premium)**功能。
- 价格与试用:提供 3 天免费试用,之后 $5.99/周 或 $39.99/年(以商店内显示的当地价格为准)。
- 计费与自动续订:订阅经由你的 Apple App Store / Google Play 账户计费;除非在当期结束前至少 24 小时取消,否则将自动续订,并按相同周期扣费。试用期内未取消的部分将在试用结束时转为付费。
- 管理与取消:你可随时在 App Store / Google Play 账户设置中管理或取消订阅;取消在当前计费周期结束时生效。
- 退款:退款受 Apple / Google 各自政策约束;我们一般无法直接处理通过商店购买的退款。
- 我们可在合理通知后调整价格或订阅内容,变更不影响你已支付的当期。
9. 知识产权
本应用及其软件、品牌、商标、UI、品种百科等内容(用户内容除外)的知识产权归我们或我们的许可方所有。我们授予你一项有限、非独占、不可转让、可撤销的许可,仅供你个人、非商业地使用本应用。
10. 第三方服务
本应用可能集成或导流至第三方服务(如持牌兽医 / 在线问诊、订阅管理 RevenueCat、应用商店、分析与云服务)。这些第三方由其各自条款与隐私政策约束;转诊到第三方持牌兽医的任何诊疗 / 处方由该持牌方在其合规框架内完成,我们仅做导流,不参与诊疗决策,亦不对第三方服务负责。
11. 免责声明(按"现状"提供)
在适用法律允许的最大范围内,本服务按**"现状"与"现有"**提供,不附任何明示或默示担保(包括适销性、特定用途适用性、不侵权、准确性或不间断/无错误运行)。我们不保证识别、情绪或健康初筛结果的准确性或完整性。
12. 责任限制
在适用法律允许的最大范围内,我们及关联方对任何间接、偶然、特殊、后果性或惩罚性损害(含数据丢失、利润损失、宠物健康相关损失)概不负责;我们对你就本服务承担的累计总责任,不超过你在索赔事件发生前 12 个月内为本服务实际支付的金额(或在适用法律允许时为 50 美元)。部分辖区不允许排除某些担保或限制责任,相关限制在该等辖区可能不适用。
13. 赔偿
因你违反本条款或滥用服务而引起的任何第三方索赔、损失或费用(含合理律师费),你同意予以赔偿并使我们免受损害。
14. 终止
你可随时停止使用并删除本应用。若你违反本条款,我们可在合理范围内暂停或终止你的访问。终止后,性质上应继续有效的条款(如知识产权、免责、责任限制、争议解决)继续有效。
15. 条款变更
我们可不时更新本条款;重大变更将通过 App 内通知或更新本页"最近更新"日期告知。变更生效后你继续使用即视为接受。
16. 适用法律与争议解决
本条款受 the United States 法律管辖(不含其冲突法规则)。因本条款产生的争议应提交至 the United States 有管辖权的法院 / 依约定的仲裁规则解决,具体以法务最终确定为准。
17. Apple / Google 平台特别条款
- 若你通过 Apple App Store 下载:本条款仅在你与我们之间订立,与 Apple 无关;Apple 不负责本应用及其内容的维护与支持;在适用法律允许范围内,Apple 不承担任何产品责任、第三方索赔或合规相关义务;Apple 及其子公司为本条款的第三方受益人,有权据此对你强制执行。你须遵守适用的使用规则(Apple Media Services 条款)。
- 若你通过 Google Play 下载:你须遵守 Google Play 服务条款;相关支付、退款由 Google 处理。

1. Acceptance
Welcome to PetPal (the "App" or "Service"), provided by PetPal ("we", "us"). By downloading, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms of Use (the "Terms") and our Privacy Policy. If you do not agree, do not use the App.
2. Eligibility
The App is not directed to children under 13 (16 in some regions). You represent that you meet the minimum age in your jurisdiction and have full capacity to enter into these Terms. If you use the App on behalf of an organization, you represent that you are authorized to bind it.
3. The Service
The App provides AI-based: (a) breed identification for dogs and cats (Top-3 + confidence); (b) an entertainment mood read; and (c) a health pre-screen and pet health profile / reminders (subscription features). Features may change across releases.
4. Important: Assistive Aid, NOT a Veterinary Diagnosis (Core Compliance)
- All AI output is an assistive screening aid — NOT a veterinary diagnosis, treatment, prescription, or professional advice, and does not replace a licensed veterinarian.
- The health pre-screen only flags signs that may be worth attention and cannot diagnose any condition; every health result carries a confidence score and disclaimer and routes abnormal/uncertain cases to a licensed veterinarian.
- Most jurisdictions require a VCPR (Veterinarian-Client-Patient Relationship, generally an in-person exam within ~12 months) before remote diagnosis/prescribing. The App holds no veterinary license and cannot establish a VCPR, so it performs referral/triage only — no diagnosis or prescribing.
- Mood reading is for entertainment only, with no scientific or accuracy claim.
- Emergencies: if your pet shows urgent or serious symptoms, contact a licensed veterinarian or emergency service immediately — do not rely on the App. You are solely responsible for decisions you make based on the App.
5. Your Account & Responsibilities
If accounts are offered, you are responsible for safeguarding your credentials and for activity under your account, and you agree the information you provide is true, accurate, and complete. You agree not to misuse or interfere with the Service.
6. User Content & Photo License
- You own the pet photos and profile information you upload ("User Content").
- To provide the Service, you grant us a limited, worldwide, non-exclusive, royalty-free license solely to process, transmit, store, and display your User Content to operate features (e.g., sending a photo to our AI inference gateway). Photos are used transiently for inference and discarded by default and are stored (encrypted) only if you save them to a profile (see Privacy Policy).
- You represent you have the rights to the content you upload and that it does not infringe others' rights or violate law.
7. Acceptable Use
You agree not to: (a) use the App for any unlawful purpose or in violation of these Terms; (b) upload infringing, unlawful, or malicious content; (c) reverse engineer, decompile, or attempt to extract source code (except as permitted by law); (d) interfere with, attack, or overload the Service or bypass rate-limiting/security; (e) scrape, bulk-automate, or resell the Service; or (f) present pre-screen results to others as a veterinary diagnosis.
8. Subscriptions, Billing & Auto-Renewal
- Free vs. paid: breed ID and mood reading are free; health pre-screen, pet profile, and reminders are subscription (Premium) features.
- Price & trial: a 3-day free trial, then $5.99/week or $39.99/year (local prices as shown in-store apply).
- Billing & auto-renewal: subscriptions are billed through your Apple App Store / Google Play account and auto-renew for the same period unless canceled at least 24 hours before the current period ends. An unused trial portion is forfeited when you subscribe.
- Manage & cancel: manage or cancel anytime in your App Store / Google Play account settings; cancellation takes effect at the end of the current billing period.
- Refunds: refunds are governed by Apple's / Google's respective policies; we generally cannot process refunds for store purchases directly.
- We may change prices or subscription contents with reasonable notice, without affecting the period you have already paid for.
9. Intellectual Property
The App and its software, brand, trademarks, UI, and breed encyclopedia (excluding User Content) are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use.
10. Third-Party Services
The App may integrate with or refer you to third parties (e.g., licensed veterinarians / tele-vet, subscription manager RevenueCat, app stores, analytics and cloud providers), each governed by its own terms and privacy policy. Any consult/prescription by a referred licensed vet is performed within that party's compliance framework; we only refer traffic, do not participate in clinical decisions, and are not responsible for third-party services.
11. Disclaimers ("As Is")
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted/error-free operation). We do not warrant the accuracy or completeness of breed, mood, or health pre-screen results.
12. Limitation of Liability
To the maximum extent permitted by law, we and our affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages (including loss of data, profits, or pet-health-related losses). Our total cumulative liability for the Service will not exceed the amount you actually paid for the Service in the 12 months before the claim (or USD 50 where permitted). Some jurisdictions do not allow certain exclusions/limitations, which may not apply to you.
13. Indemnification
You agree to indemnify and hold us harmless from any third-party claims, losses, or costs (including reasonable attorneys' fees) arising from your breach of these Terms or misuse of the Service.
14. Termination
You may stop using and delete the App at any time. We may suspend or terminate your access if you breach these Terms. Provisions that by their nature should survive (e.g., IP, disclaimers, limitation of liability, dispute resolution) survive termination.
15. Changes to the Terms
We may update these Terms from time to time; material changes will be notified in-app or by updating the "Last Updated" date above. Continued use after changes take effect constitutes acceptance.
16. Governing Law & Disputes
These Terms are governed by the laws of the United States (excluding conflict-of-laws rules). Disputes will be resolved by the competent courts / under the agreed arbitration rules of the United States, as finalized by legal counsel.
17. Apple / Google Platform Terms
- If downloaded via the Apple App Store: these Terms are between you and us only, not Apple; Apple has no obligation to maintain or support the App; to the extent permitted by law, Apple has no warranty, product-liability, or third-party-claim obligations for the App; Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You must comply with applicable Usage Rules (Apple Media Services Terms).
- If downloaded via Google Play: you must comply with the Google Play Terms of Service; payments and refunds are handled by Google.
